Terms of service
1. About these terms
These terms of service (“terms”) form an agreement between you and Strathmore University, acting through the Strathmore Agri-Food Innovation Center (SAFIC)(“we”, “us”) about your use of SAFIC AgriIntel, its website, app and public pages (“AgriIntel”, the “service”).
By creating an account, or by using the service without an account, you accept these terms and our privacy policy. If you use AgriIntel on behalf of an organisation, you confirm that you are authorised to accept these terms for it, and “you” includes that organisation. If you do not accept these terms, do not use the service.
2. Who may use AgriIntel
You must be at least 18 years old and able to enter into a binding agreement. You may not use the service if we have previously closed your account for breaking these terms, or if the law prohibits you from using it.
3. The service
AgriIntel answers questions about Kenyan agriculture using official statistics, research reports, market data and other sources, and shows the sources behind each answer. It also offers public price and county pages, saved answers, workspaces, shared links and downloads.
AgriIntel is in beta. We are continually changing it: features may be added, changed, limited or removed, and the service may be unavailable from time to time for maintenance or for reasons outside our control. We will try to give notice of significant changes, but we do not promise that any feature or level of availability will continue.
The service is currently free of charge. If we introduce fees for any part of it, we will tell you in advance and you will not be charged unless you agree.
4. Your account
- Give accurate, current information when you sign up, and keep it up to date.
- Keep your password confidential and do not share your account. Each account is for one person.
- You are responsible for activity on your account unless it results from our failure to keep the service secure.
- Tell us promptly at saficai@strathmore.edu if you suspect unauthorised use of your account.
- Fair-use limits, such as on the number of questions or downloads, may apply. The app shows the limits that apply to you.
5. Acceptable use
You agree not to, and not to help anyone else to:
- use the service in breach of any law, or of anyone else’s rights, including privacy and intellectual property rights;
- enter personal data about other people, or confidential information you are not entitled to share, into the service;
- gain unauthorised access to the service, other accounts or our systems, or get around access controls, fair-use limits or security measures;
- scrape, crawl, bulk-download or systematically extract content or data, except through features the service provides for that purpose;
- use the service or its outputs to build or train a competing product or AI model;
- interfere with or overload the service, or test it for vulnerabilities without our written permission (please report security issues to saficai@strathmore.edu);
- upload malicious code, or submit content designed to manipulate the service’s answers or behaviour;
- present AgriIntel’s answers as official statistics or as the views of Strathmore University or any source publisher;
- use the service to harass, defraud, mislead or harm anyone.
6. AI-generated answers
Answers are generated automatically by artificial intelligence from the sources AgriIntel holds and, sometimes, from the web. Although we work to make them accurate and show their sources, answers can be incomplete, out of date, misattributed or wrong.
- Answers are general information. They are not professional, financial, investment, legal, agronomic, veterinary or policy advice, and do not take your circumstances into account.
- Check key figures against the cited sources before you rely on them, publish them or make decisions with them.
- You are responsible for how you use answers, and for any decisions you make based on them.
7. Content and intellectual property
Our content. The AgriIntel software, design, branding and our own compilations, analyses and text are owned by or licensed to Strathmore University and are protected by intellectual property laws. Except as these terms allow, you may not copy, modify, distribute or create derivative works from them.
Source material. Statistics, reports and other material from third parties belong to their publishers and remain subject to their own terms and licences. When you reuse a figure, cite the original source shown with it.
Using answers.You may use, quote and adapt answers and downloads for your own personal, research, educational and professional work, including in reports you publish, provided you cite the underlying sources and, where practical, acknowledge “SAFIC AgriIntel”. You may not resell the service or its outputs as a data product.
Your content.You keep any rights you have in the questions, notes and feedback you submit (“your content”). You give us a non-exclusive, worldwide, royalty-free licence to host, process and display your content to provide the service to you and to the people you share it with, and to improve the service as described in our privacy policy. You confirm that you have the right to submit your content.
Feedback. If you give us suggestions or feedback, we may use them without restriction or payment to you.
9. Third-party sources and websites
The service cites and links to websites and documents published by others. We do not control them and are not responsible for their content, availability or practices. Including a source does not mean we endorse it.
10. Privacy
Our privacy policy explains how we collect and use personal data and the rights you have under the Kenya Data Protection Act, 2019. It forms part of these terms.
11. Suspension and closing your account
You may stop using AgriIntel at any time, and ask us to close your account by emailing saficai@strathmore.edu.
We may suspend or close your account, or limit your access, if you seriously or repeatedly break these terms, if your use creates a risk for the service, other users or the University, or if the law requires us to. Where it is reasonable and lawful, we will tell you why and give you a chance to respond first. We may also end the service as a whole by giving reasonable notice.
When your account closes, your right to use the service ends and we will delete your data as described in our privacy policy. Sections 7, 12, 13, 14, 16 and 17 continue to apply.
12. Disclaimer
To the extent the law allows, the service and its content are provided “as is” and “as available”, without warranties of any kind, whether express or implied, including warranties of accuracy, completeness, fitness for a particular purpose, non-infringement, or uninterrupted or error-free operation. Nothing in these terms affects rights you have as a consumer that cannot be excluded by law, including under the Consumer Protection Act, 2012 of Kenya.
13. Limitation of liability
To the extent the law allows:
- we are not liable for any indirect, incidental, special or consequential loss, or for any loss of profit, revenue, business, data or opportunity;
- we are not liable for decisions or actions taken on the basis of AgriIntel’s answers or content;
- our total liability to you for all claims relating to the service is limited to the greater of the amount you paid us for the service in the 12 months before the claim and KES 10,000.
Nothing in these terms limits or excludes liability for death or personal injury caused by negligence, for fraud, or for any other liability that cannot be limited or excluded by law.
14. Your responsibility to us
To the extent the law allows, you agree to compensate us for reasonable losses, costs and claims by third parties that arise from your breach of these terms or your misuse of the service. This does not apply to the extent a loss is caused by us.
15. Changes to these terms
We may update these terms, for example to reflect changes to the service or the law. We will post the new version here with a new effective date. If a change is material, we will tell account holders by email or in the app at least 30 days before it takes effect, unless a change is needed sooner for legal or security reasons. If you continue to use the service after the change takes effect, the updated terms apply; if you do not accept them, you may close your account.
16. Governing law and disputes
These terms, and any dispute or claim arising from them or the service, are governed by the laws of Kenya.
If you have a concern, please contact us first at saficai@strathmore.edu: most issues can be resolved informally. If a dispute is not resolved within 30 days of either party raising it in writing, either party may refer it to mediation, and if it remains unresolved, to the courts of Kenya, which will have jurisdiction. This does not stop you from bringing a claim in the courts of the country where you live if the law of that country gives you that right.
17. General
- Entire agreement. These terms and the privacy policy are the whole agreement between you and us about the service.
- Severability. If a court finds any part of these terms unenforceable, the rest remains in effect.
- No waiver. If we do not enforce a right straight away, we can still enforce it later.
- Transfer. You may not transfer your rights under these terms. We may transfer ours to an organisation that takes over the service, without reducing your rights.
- Events outside our control. We are not responsible for delays or failures caused by events beyond our reasonable control.
- Notices. We may send notices to the email address on your account or show them in the app. You can send notices to the contact details below.
- Language. These terms are written in English, which prevails over any translation.
